General Terms and Conditions

Article 1: This seasonal rental agreement is reserved for the exclusive use of Gite du Château Monrtond les Bains accommodation rentals.

 

Article 2 – Length of Stay: The tenant signing this agreement, entered into for a fixed period, may not under any circumstances claim any right to remain in the premises at the end of the stay.

 

Article 3 – Conclusion of the Agreement: The reservation becomes effective once the tenant has sent the owner a deposit equal to 50% of the total rental amount and a copy of the signed agreement before the date indicated on the front. A second copy is to be retained by the tenant.

The rental agreement entered into between the parties to this agreement may under no circumstances benefit, even partially, third parties, whether natural or legal persons, without the written consent of the owner. Any violation of this last paragraph may result in the immediate termination of the rental agreement at the tenant’s expense, with the rental income remaining permanently acquired by the owner.

 

Article 4 – No Right of Withdrawal: For reservations made by mail, telephone, or online, the tenant does not benefit from the right of withdrawal, in accordance with Article L121-21-8 of the French Consumer Code, which relates in particular to accommodation services provided on a specific date or at a specific frequency.

 

Article 5 – Cancellation by the tenant: Any cancellation must be notified to the owner by registered letter.

a) Cancellation before arrival:
The owner retains the deposit. The owner may request the balance of the stay if the cancellation occurs less than 30 days before the scheduled arrival date.

If the tenant does not respond within 24 hours of the arrival date indicated on the contract, this contract becomes null and void, and the owner may dispose of the accommodation. The deposit also retains the owner, who will request payment of the remaining rental amount.

b) If the stay is shortened, the rental price remains with the owner. No refund will be issued.

 

Article 6 – Cancellation by the owner: The owner will refund the tenant all amounts paid, as well as compensation at least equal to the amount the tenant would have incurred if the cancellation had been made by the owner on that date.

 

Article 7 – Arrival: The tenant must arrive on the date and time specified in this contract. In the event of late or delayed arrival, the tenant must notify the owner.

 

Article 8 – Payment of the balance: The balance of the rental is paid 30 days before arrival.

 

Article 9 – Inventory: An inventory is drawn up jointly and signed by the tenant and the owner or their representative upon arrival and departure from the gîte. This inventory constitutes the sole reference in the event of a dispute regarding the inventory.

The cleanliness of the gîte upon the tenant’s arrival must be noted in the inventory. Cleaning the premises is the tenant’s responsibility during the rental period and prior to departure. Any cleaning fees are calculated based on the information sheet.

 

Article 10 – Security Deposit: Upon the tenant’s arrival, the landlord will require a security deposit in the amount indicated on the front of this contract. After the tenant has completed a joint inventory of fixtures and fittings, this deposit will be returned, less the cost of restoring the premises if any damage is noted. In the event of early departure (before the time specified in this contract) preventing the tenant from completing the inventory on the day of the tenant’s departure, the landlord will return the security deposit within one week.

 

Article 11 – Use of the Premises: The tenant must ensure the peaceful nature of the rental and use it in accordance with its intended purpose.

 

Article 12 – Capacity: This contract is designed for a maximum capacity of 1,000 people. If the number of tenants exceeds the capacity, the owner may refuse additional guests. Any modification or termination of the contract will be considered at the client’s initiative.

 

Article 13 – Pets: This contract specifies whether or not the tenant may stay with a pet. In the event of non-compliance with this clause, the owner may refuse the stay: no refund will be issued. When booking, the client is required to indicate the number of pets they will be accompanying. If applicable, the description specifies any additional charges to be expected (pet fee, deposit supplement, cleaning fee supplement, etc.). Specific terms and conditions for pets may be specified by the owner in the house rules posted in the accommodation.

 

Article 14 – Insurance: The tenant is responsible for all damages incurred by them. They are required to have a standard holiday insurance policy for these various risks.

 

Article 15 – Payment of charges: At the end of the stay, the tenant must pay the owner any charges not included in the price.
The amount is based on the calculation mentioned in this contract and in the description sheet, and proof is provided by the owner.

 

Article 16 – Disputes: Any complaint regarding the inventory of fixtures and the condition of the property during a rental must be submitted to the Departmental or Interdepartmental Office of Gîtes de France within three days of moving into the premises. Any other complaint must be addressed to him as soon as possible, by letter.
